The McKinney-Vento Act is a federal law guaranteeing all children and youth the right to an equal education, regardless of their living situation. Protection under the McKinney-Vento Act extends to students experiencing homelessness who lack a fixed, regular, and adequate nighttime residence.
Are you currently living:
- In a shelter or transitional housing
- In a motel or hotel
- In a tent, RV, public space, vehicle or campground
- With others due to economic hardship or a loss of housing
If you are experiencing any of these situations, please contact our McKinney-Vento liaison who can refer you to resources and help coordinate services.
Eligible students have the right to:
- Expedited enrollment in the appropriate school
- Receive free/reduced price meals
- Attend their school of origin
- Receive support from the district’s McKinney-Vento liaison

McKinney-Vento Dispute Resolution Process
Creswell School District is committed to ensuring that students experiencing housing instability have access to a free, appropriate public education. Under the federal McKinney-Vento Homeless Assistance Act, parents, guardians, and unaccompanied youth have the right to dispute decisions regarding a student’s eligibility for McKinney-Vento services, school selection, or enrollment.
How to resolve a dispute
If you disagree with a decision regarding McKinney-Vento eligibility, school selection, or enrollment, please contact the Creswell School District McKinney-Vento Liaison to discuss your concerns and begin the dispute resolution process.
- Contact the district liaison. Explain the decision you disagree with and request a review. The district will work to resolve the concern as quickly as possible.
- Receive a written explanation. The district will provide a written explanation of its decision, the reasons for the decision, and instructions for appealing it.
- Request a district-level appeal. If the concern cannot be resolved, you may appeal the decision through the district’s established dispute resolution process.
- Request a state-level appeal. If you disagree with the district’s final determination after completing the available district-level appeals, you may request review by the Oregon Department of Education (ODE).
School enrollment during a dispute
When a dispute concerns McKinney-Vento eligibility, school selection, or enrollment, the student must be immediately enrolled in the school they are seeking to attend and remain enrolled while the dispute and any available appeals are resolved, as required by federal law.
